Is electronic signature legal in Argentina?
Yes, with some exceptions. Argentina's Digital Signature Law 25.506 distinguishes a digital signature, which meets any legal signature requirement, from a general electronic signature, which the party relying on it must prove is genuine if it is challenged. The law's original list of excluded acts was repealed in 2018, but acts that the Civil and Commercial Code subjects to special formalities, such as wills and public deeds before a notary, must still follow those formalities.

Digital signature (firma digital)
Created with a certificate from a licensed certifier and verifiable by third parties. It satisfies any legal signature requirement and is presumed to belong to the certificate holder and to be unaltered.
What you can sign electronically in Argentina
- Commercial contracts
- Service and supply agreements
- Employment documents
- Dealings with public administration using digital signatures
Documents that need a handwritten signature or extra formalities
- Wills, which must follow the formalities of the Civil and Commercial Code (for example a handwritten will or a will by public deed before a notary)
- Family law acts that the Civil and Commercial Code subjects to specific formalities, such as marriage
- Acts that the law requires to be granted by public deed before a notary, such as real estate transfers, which follow notarial rules
Contracts that must be “in writing”

E-signatures in Argentina: frequently asked questions
Is a simple e-signature enough for a contract in Argentina?
It can be, but it carries no presumption. If the other party denies it, the party relying on it must prove it is genuine. A digital signature is presumed to belong to the certificate holder and the document is presumed unaltered.
Can I get a digital certificate remotely?
Yes. Decree 743/2024 allowed remote identity checks using biometric validation against the national persons registry and removed the obligation to appear in person to obtain a certificate.
Can wills be signed electronically in Argentina?
Generally no. The exclusion in Ley 25.506 was repealed in 2018, but the Civil and Commercial Code still requires wills to follow specific formalities, such as a will written, dated and signed by hand by the testator or a will by public deed before a notary.
