A Commonwealth statutory declaration is a written statement that you declare to be true in front of an approved witness, under the Statutory Declarations Act 1959. Commonwealth agencies, employers, banks and others ask for one when they need a formal statement of facts. Download the blank form from ag.gov.au, open it in BunnyDoc's free Sign PDF tool, type in your details and statement, then sign it with your witness watching, in person or over a video call. Everything happens in your browser, so the file never leaves your device.

How to fill in and sign Statutory declaration

  1. Get the current form

Download the blank Commonwealth statutory declaration from the Attorney-General's Department. Make sure it is the Commonwealth form; states and territories have their own statutory declarations.

  2. Enter your name, address and occupation (section 1)

Write your full legal name, an address where you can be contacted, such as home or work, and your occupation. The department says not to put an email address in this section.

  3. Write your statement (section 2)

Type your statement in numbered paragraphs. If it runs over more than one page, number each page; you and your witness initial each page.

  4. Arrange an approved witness

Find a witness listed in Schedule 1 of the Statutory Declarations Regulations 2023, such as a Justice of the Peace. The witness can be with you in person or on a video call with sound, for example Zoom or Microsoft Teams.

  5. Sign while the witness watches

Sign with a pen or an electronic signature while the witness watches. You and the witness must sign together, in one in-person visit or one video call.

  6. Have the witness complete their part, then send it

The witness fills in their details, signs and dates every page, including attachments. Give the completed declaration to the organisation that asked for it.

What you need before you start

  • Your full legal name, a contact address and your occupation.
  • The facts you need to declare, set out in numbered paragraphs.
  • An approved witness, such as a Justice of the Peace. The department's page on making a statutory declaration with a witness explains who qualifies.
  • Photo ID for the witness to check who you are.

Can I sign a statutory declaration electronically?

Yes. The Attorney-General's Department says you can sign with a pen or an electronic signature, and the witness can watch in person or over a video link. You and the witness must sign at the same time, in a single visit or video call, and the witness must see you sign. A third option is a digital statutory declaration in myGov using your Digital ID, which needs no witness. Each method creates an equally valid declaration.

For background, see whether e-signatures are legal.

Common mistakes

  • Signing before the witness is watching.
  • Using a witness who is not on the approved list.
  • Leaving pages of a long statement unnumbered or uninitialled.
  • Using a state or territory form when a Commonwealth declaration was asked for, or the other way round.
