This is the Decision Support Service's specimen of the enduring power of attorney (EPA) under the Assisted Decision-Making (Capacity) Act 2015. Every page is marked 'SAMPLE - DO NOT USE': it lets you see the questions before you start, but the real EPA is made through the MyDSS online portal. You can open the specimen from this page to read and make notes on it in your browser; nothing leaves your device.
How to fill in EPA (Ireland)
Read the specimen and the guide
Use the specimen to see what the EPA asks for, and read the DSS guide to an enduring power of attorney.
Gather the donor details (section 1)
The donor's name, date of birth, PPS number, addresses and contact details, plus optional notes about living arrangements and communication needs.
Choose attorneys (section 2)
Choose one or more attorneys and any replacement attorneys, and decide whether they act jointly, jointly and severally, or a mix.
Arrange the statements
A lawyer must interview the donor and confirm they understand the EPA, and a doctor or other healthcare professional who is not immediate family assesses capacity.
Make the EPA through the DSS
Create the EPA in MyDSS. The donor and attorney sign their declarations in front of two witnesses, notice parties are told, and the attorney applies to register it when needed. Contact the DSS on (01) 211 9750 if the donor cannot use the online portal.
What you need before you start
- The donor's PPS number and contact details.
- Details of each attorney and replacement attorney.
- A lawyer and a healthcare professional to give their statements.
- Two witnesses and a list of notice parties.
- A MyDSS account.
Can I use this PDF as my EPA?
No. It is a specimen only. The Decision Support Service takes a "digital first" approach: EPAs are made through the MyDSS portal, and a paper process exists for donors who cannot complete the online steps even with support. See the DSS EPA FAQ.
Fees
The DSS fees page lists €90 for notification of an EPA and €30 for an application to register an EPA, with €12 to object. Some fees can be waived based on household income.
