How to fill in Cerfa 13592

  1. Read the notice first

The form asks you to read notice 51226 before filling it in. It explains the options and the limits of a private-deed mandate.

  2. Fill in your details and choose your mandataire

Enter your identity and the person or people you appoint. A company can be appointed only if it is on the préfet's list of mandataires judiciaires à la protection des majeurs.

  3. Choose the scope of the mandate

Tick the options you want for protection of your person and of your property. Where the form offers an option, copy its wording by hand in the space provided.

  4. Print and sign every page by hand

Print all copies, sign each page of every original and date the last page. Copy by hand the sentence stating you are not under a tutelle. If you are under curatelle, your curateur co-signs.

  5. Have the mandataire accept

Each mandataire copies the acceptance sentence by hand, dates it and signs. Any control person also accepts and signs.

  6. Register it if you want a fixed date

You can register the originals with the tax office (recette des impôts) for your home to give the mandate a certain date. The notice estimates the cost at about €125.

What you need before you start

  • The full identity of each person you appoint.
  • A clear idea of what they should manage.
  • The form and the notice.

Can I sign a mandat de protection future electronically?

No. The notice says you sign every page of every original by hand and copy certain sentences in your own handwriting. Fill it in on screen if you like, then print it and sign it by hand. See whether e-signatures are legal for why some documents still need ink.

Private deed or notary?

Under article 492 of the Civil Code, a private-deed mandate is either countersigned by a lawyer or follows the official model (this form). It only allows acts of administration, such as managing your property and collecting income. To let your mandataire sell property, the mandate must be made before a notary.

How the mandate takes effect

  • A doctor on the procureur de la République's list examines you and issues a medical certificate.
  • The mandataire takes the mandate and the certificate (less than two months old) to the greffe of the tribunal judiciaire where you live.
  • The greffier stamps the mandate, and the mandataire can then use it.
