Is electronic signature legal in Indonesia?
Yes. Indonesia's Electronic Information and Transactions Law (UU ITE) and Government Regulation 71 of 2019 give electronic signatures legal force, with certified signatures from a registered Indonesian provider carrying the strongest evidential weight. Other laws can still require paper or notarial form, for example for notarial and land deeds.

Types of electronic signature in Indonesia
Uncertified electronic signature (tanda tangan elektronik tidak tersertifikasi)
Created without an Indonesian certification provider. Legally valid if it meets the statutory requirements, but the party relying on it may need to prove its reliability. It cannot be used for high-risk transactions, which require a certified signature.
Certified electronic signature (tanda tangan elektronik tersertifikasi)
Issued through an Indonesian electronic certification provider (PSrE) registered with the ministry. It carries stronger evidential weight in court.
What you can sign electronically in Indonesia
- Commercial contracts
- Employment agreements
- Fintech and lending agreements (high-risk transactions, such as financial transactions not made face to face, must use a certified electronic signature)
- Service agreements
Documents that need a handwritten signature or extra formalities
- Documents that another law requires to be made in a specific form, such as notarial deeds
- Land deeds made before a land deed official (PPAT)
Contracts that must be “in writing”
UU ITE treats electronic information and documents as valid legal evidence. Law No. 1 of 2024 amended the exception in article 5(4), which now states that these rules do not apply where another law provides otherwise, rather than listing written documents and notarial deeds directly.
E-signatures in Indonesia: frequently asked questions
Are e-signed contracts valid in Indonesia?
Yes. UU ITE and PP 71/2019 recognize electronic signatures, and a certified signature from a registered Indonesian provider gives the strongest evidence.
Do I need a certified e-signature in Indonesia?
Not for every contract. Since the 2024 amendment, article 17(2a) of UU ITE requires electronic transactions that carry a high risk for the parties, such as financial transactions not made face to face, to use an electronic signature secured by an electronic certificate. Some sector rules, such as OJK regulations, also require certified signatures.
Can notarial deeds be signed electronically in Indonesia?
Generally no. Notarial and land deeds follow the Notary Law and land regulations, which require physical formalities.
