Is electronic signature legal in Pakistan?

Legal

Yes, with some exceptions. Pakistan's Electronic Transactions Ordinance 2002 lets electronic signatures meet legal signature requirements, and an advanced electronic signature gives a presumption of authenticity and integrity. Negotiable instruments, powers of attorney, trusts, wills and contracts for the sale or conveyance of immovable property are excluded.

Types of electronic signature in Pakistan

  • Electronic signature

Any letters, numbers, symbols, images or other electronic marks attached to a document to show authenticity or approval. It satisfies a legal signature requirement and can be proved in any manner.

  • Advanced electronic signature

Unique to the signer, capable of identifying them, under their sole control and linked to the document so that changes are detectable, or provided by an accredited certification service provider. Courts presume such documents are authentic and unaltered unless shown otherwise.
