Is electronic signature legal in Malaysia?

Legal

Types of electronic signature in Malaysia

  • Electronic signature

Satisfies a legal signature requirement if it is attached to the message, identifies the person and shows approval, and is as reliable as appropriate (section 9 of the Electronic Commerce Act).

  • Digital signature

A certificate-based signature issued by a certification authority licensed under the Digital Signature Act 1997. Required where the law requires a seal, and gives a strong presumption of validity.

What you can sign electronically in Malaysia

  • Commercial and sales contracts
  • Service agreements
  • Employment documents
  • Tenancy agreements (subject to stamping)

Documents that need a handwritten signature or extra formalities

  • Powers of attorney
  • Wills and codicils
  • Trusts
  • Negotiable instruments
  • Instruments affecting land under the National Land Code 1965, which follow their own forms and registration rules
  • Documents that must be attested or notarised, such as affidavits and statutory declarations

Contracts that must be “in writing”

The Electronic Commerce Act provides that a legal requirement for writing is met by an electronic message that is accessible for later reference, and a signature requirement by a reliable electronic signature. Where the law requires a seal, a digital signature under the Digital Signature Act is needed.
