Is electronic signature legal in the Czech Republic?

Legal

Yes. The Czech Civil Code allows written legal acts to be made and signed electronically, and Act No. 297/2016 Coll. allows any eIDAS signature type in private dealings. Courts may expect an advanced or qualified signature in a dispute, and dealings with public bodies have stricter rules.

Types of electronic signature in the Czech Republic

  • Simple electronic signature

Any electronic data used to sign, such as a typed name, a click-to-sign box or a drawn signature. Under eIDAS it cannot be refused as evidence just because it is electronic, and it is used for most everyday contracts. Czech courts have sometimes required stronger signatures where written form is contested.

  • Advanced electronic signature (AES)

Uniquely linked to and able to identify the signer, under the signer's sole control, and linked to the data so later changes are detectable. It carries more evidential weight than a simple signature. In Czech law called 'zaručený elektronický podpis'.

  • Qualified electronic signature (QES)

An advanced signature made with a qualified signature creation device and based on a qualified certificate from a trust service provider on an EU trusted list. It has the same legal effect as a handwritten signature in every EU member state.

What you can sign electronically in the Czech Republic

  • Most commercial contracts
  • Employment contracts, which since 1 October 2023 can be concluded electronically by email or an HR signing system
  • Contracts that require written form (§§ 561 and 562 Civil Code), preferably signed with an advanced or qualified signature
  • Consumer contracts

Documents that need a handwritten signature or extra formalities

  • Acts that require a notarial deed or officially verified signature
  • Wills, which must meet the Civil Code's form rules
  • Submissions to public authorities, which generally require a recognised (advanced based on a qualified certificate, or qualified) electronic signature

Contracts that must be “in writing”

Under § 561 of the Civil Code a written legal act needs the acting person's signature, and a legal act made electronically can be signed electronically under other laws. Under § 562, written form is also kept when a legal act is made by electronic means that capture its content and identify the acting person. Courts have often looked for an advanced or qualified signature before treating an electronic act as written.
