Is electronic signature legal in Spain?

Legal

Yes. Spain applies eIDAS directly, supplemented by Ley 6/2020, and contracts concluded electronically are valid under Ley 34/2002. Acts that need a public deed before a notary, and family and succession law contracts, follow their own rules.

Yes. The eIDAS Regulation applies directly, so a qualified e-signature from any EU country has the effect of a handwritten signature.

Types of electronic signature in Spain

  • Simple electronic signature

Any electronic data used to sign, such as a typed name, a click-to-sign box or a drawn signature. Under eIDAS it cannot be refused as evidence just because it is electronic, and it is used for most everyday contracts.

  • Advanced electronic signature (AES)

Uniquely linked to and able to identify the signer, under the signer's sole control, and linked to the data so later changes are detectable. It carries more evidential weight than a simple signature.

  • Qualified electronic signature (QES)

An advanced signature made with a qualified signature creation device and based on a qualified certificate from a trust service provider on an EU trusted list. It has the same legal effect as a handwritten signature in every EU member state. Under Ley 6/2020, a document signed through a qualified service listed on the trusted list is presumed authentic, and the party challenging it must prove otherwise.

What you can sign electronically in Spain

  • Most commercial contracts (Spanish law follows freedom of form)
  • Employment contracts
  • Consumer and distance contracts
  • Private real estate purchase agreements before the public deed

Documents that need a handwritten signature or extra formalities

  • Contracts governed by family law and succession law (excluded from the electronic contracting rules of the LSSI)
  • Acts that require a public deed or the intervention of a notary, registrar or court, which follow their own legislation (for example the public deed for registering real estate)
  • Wills, which must follow the forms in the Código Civil

Contracts that must be “in writing”

Under the LSSI, when the law requires a contract or information to be in writing, that requirement is met if it is contained in an electronic medium. Ley 6/2020 leaves the value of public documents and notarial functions to their own rules.

E-signatures in Spain: frequently asked questions

Are e-signed employment contracts valid in Spain?

Yes. Employment contracts can be signed electronically. Using an advanced or qualified signature makes it easier to prove who signed if the contract is challenged.

What changed with Ley 6/2020?

It replaced the Ley 59/2003 on electronic signatures and adapted Spanish law to eIDAS. It confirms that documents signed through a qualified service enjoy a presumption of authenticity in court.

Can I buy property in Spain with an e-signature?

The private purchase contract can be signed electronically, but transferring and registering the property normally requires a public deed executed before a notary.
