Is electronic signature legal in Portugal?

Legal

Yes. Portugal applies eIDAS through Decreto-Lei n.º 12/2021, which gives a qualified electronic signature the same effect as a handwritten one. Other signatures are valid if the parties agree to them or a court accepts them, while acts needing a public deed follow notarial rules.

Yes. The eIDAS Regulation applies directly, so a qualified e-signature from any EU country has the effect of a handwritten signature.

Types of electronic signature in Portugal

  • Simple electronic signature

Any electronic data used to sign, such as a typed name, a click-to-sign box or a drawn signature. Under eIDAS it cannot be refused as evidence just because it is electronic, and it is used for most everyday contracts. In Portugal its value depends on an agreement between the parties or on the court's assessment.

  • Advanced electronic signature (AES)

Uniquely linked to and able to identify the signer, under the signer's sole control, and linked to the data so later changes are detectable. It carries more evidential weight than a simple signature.

  • Qualified electronic signature (QES)

An advanced signature made with a qualified signature creation device and based on a qualified certificate from a trust service provider on an EU trusted list. It has the same legal effect as a handwritten signature in every EU member state. Under Decreto-Lei 12/2021 it is presumed to be the holder's signature and that the document is unchanged; Portuguese Citizen Card and Chave Móvel Digital signatures are qualified.

What you can sign electronically in Portugal

  • Most commercial contracts
  • Employment contracts
  • Contracts requiring a written signed document, if signed with a QES
  • Consumer contracts

Documents that need a handwritten signature or extra formalities

  • Acts that require a public deed (escritura pública) or authenticated private document, such as real estate transfers
  • Public wills and other acts that must be made before a notary

Contracts that must be “in writing”

A qualified electronic signature on an electronic document that can be represented as written text gives it the evidential force of a signed private document under article 376 of the Civil Code. Other e-signatures have that effect if the parties validly agreed to them.

Can I sign with my Citizen Card (Cartão de Cidadão) in Portugal?

What changed with Decreto-Lei 12/2021?

It replaced the older 1999 regime (Decreto-Lei 290-D/99) and aligned Portuguese law with eIDAS.
