Is electronic signature legal in the Netherlands?
Yes. Under article 3:15a of the Dutch Civil Code a qualified electronic signature has the same effect as a handwritten one, and other e-signatures have that effect if the method is reliable enough for the purpose. Contracts that need a notary, a court or a public authority cannot rely on the general electronic rule.

Types of electronic signature in the Netherlands
Simple electronic signature
Any electronic data used to sign, such as a typed name, a click-to-sign box or a drawn signature. Under eIDAS it cannot be refused as evidence just because it is electronic, and it is used for most everyday contracts. Under article 3:15a BW it has the effect of a handwritten signature if the method is sufficiently reliable for its purpose.
Advanced electronic signature (AES)
Uniquely linked to and able to identify the signer, under the signer's sole control, and linked to the data so later changes are detectable. It carries more evidential weight than a simple signature. The same reliability test applies under article 3:15a BW.
Qualified electronic signature (QES)
An advanced signature made with a qualified signature creation device and based on a qualified certificate from a trust service provider on an EU trusted list. It has the same legal effect as a handwritten signature in every EU member state.
What you can sign electronically in the Netherlands
- Most commercial contracts
- Employment contracts, including clauses that must be in writing, if article 6:227a conditions are met
- Residential and commercial leases
- Consumer contracts
Documents that need a handwritten signature or extra formalities
- Contracts for which the law requires the intervention of a court, a public authority or a professional exercising a public task, such as a notary (article 6:227a(2) BW)
- Transfers of real estate and mortgages, which require a notarial deed
- Wills, which are made by notarial deed or deposited with a notary

E-signatures in the Netherlands: frequently asked questions
Are e-signed employment contracts valid in the Netherlands?
Yes. Employment contracts can be signed electronically, and clauses that must be in writing, such as a non-compete, can meet that requirement if the electronic process satisfies article 6:227a BW.
Is a simple electronic signature enough in the Netherlands?
Often, yes. Article 3:15a BW gives it the same effect as a handwritten signature if the method is reliable enough given its purpose and the circumstances. For higher-value deals an advanced or qualified signature reduces the risk of dispute.
Can I buy a house with an e-signature in the Netherlands?
The purchase agreement can be signed electronically, but the transfer itself requires a notarial deed.
