Is electronic signature legal in Hungary?

Legal, with limits

Yes, with limits. Hungary applies eIDAS, and contracts without a form requirement can be signed with any electronic signature. Where Hungarian law requires written form, courts have generally accepted only advanced or qualified electronic signatures, and real estate transfers must go through an attorney or notary for the land registry.

Yes. The eIDAS Regulation applies directly, so a qualified e-signature from any EU country has the effect of a handwritten signature.

Types of electronic signature in Hungary

  • Simple electronic signature

Any electronic data used to sign, such as a typed name, a click-to-sign box or a drawn signature. Under eIDAS it cannot be refused as evidence just because it is electronic, and it is used for most everyday contracts. In Hungary it does not satisfy a statutory written form requirement.

  • Advanced electronic signature (AES)

Uniquely linked to and able to identify the signer, under the signer's sole control, and linked to the data so later changes are detectable. It carries more evidential weight than a simple signature. Hungarian courts accept it, particularly with a time stamp, as meeting written form.

  • Qualified electronic signature (QES)

An advanced signature made with a qualified signature creation device and based on a qualified certificate from a trust service provider on an EU trusted list. It has the same legal effect as a handwritten signature in every EU member state.

What you can sign electronically in Hungary

  • Commercial contracts without a statutory form requirement
  • Contracts requiring written form (such as security agreements, options and retention of title), if signed with an advanced or qualified signature
  • Finance agreements signed with AES or QES under central bank guidance

Documents that need a handwritten signature or extra formalities

  • Real estate sale agreements and statements submitted to the land registry, which must be prepared and countersigned by an attorney or made by a notary, and cannot be signed with only a simple electronic signature
  • Documents that require a notarial deed, which cannot be prepared or signed remotely
  • Any written-form contract signed only with a simple electronic signature

Contracts that must be “in writing”

Section 6:7 of the Civil Code treats an electronic statement as written if it allows the content to be retrieved unchanged and identifies the signer and the time of signing. Hungarian courts and central bank guidance have generally read this as requiring an advanced or qualified electronic signature.

E-signatures in Hungary: frequently asked questions

Are e-signed employment contracts valid in Hungary?

Employment contracts must be in writing, so use an advanced or qualified electronic signature. A simple e-signature does not meet the written form rule.

Can I use DocuSign-style simple signatures in Hungary?

For contracts without a form requirement, yes. For contracts that must be in writing, Hungarian courts have required an advanced or qualified signature.

Can real estate be sold with an e-signature in Hungary?

Not with a simple e-signature. A real estate transfer must be countersigned by an attorney or made by a notary, who files it with the land registry. Since January 2025 the land registry procedure is electronic, and the registration consent is signed with a qualified or qualified-certificate based advanced electronic signature (or the government AVDH service). Your attorney or notary will tell you which signing method to use.
