Is electronic signature legal in Greece?

Legal

Yes. Greek law generally allows contracts without formalities, and Law 4727/2020 gives a qualified electronic signature the same validity as a handwritten one. Documents that need a notarial deed, such as real estate transfers and many company law acts, follow notarial rules.

Yes. The eIDAS Regulation applies directly, so a qualified e-signature from any EU country has the effect of a handwritten signature.

Types of electronic signature in Greece

  • Simple electronic signature

Any electronic data used to sign, such as a typed name, a click-to-sign box or a drawn signature. Under eIDAS it cannot be refused as evidence just because it is electronic, and it is used for most everyday contracts. Under Law 4727/2020, a private electronic document without a qualified signature or seal is freely assessed as evidence.

  • Advanced electronic signature (AES)

Uniquely linked to and able to identify the signer, under the signer's sole control, and linked to the data so later changes are detectable. It carries more evidential weight than a simple signature.

  • Qualified electronic signature (QES)

An advanced signature made with a qualified signature creation device and based on a qualified certificate from a trust service provider on an EU trusted list. It has the same legal effect as a handwritten signature in every EU member state.

What you can sign electronically in Greece

  • Most commercial contracts (no form requirement under article 158 of the Civil Code)
  • Employment contracts
  • Contracts that require written form, if signed with a QES
  • Consumer contracts

Documents that need a handwritten signature or extra formalities

  • Real estate sales, mortgages and donations, which require a notarial deed
  • Family law contracts and certain wills
  • Company law acts that require a notarial deed (such as the formation of an EPE, transfers of EPE shares and some restructurings), and guarantees linked to a contract that needs a notarial deed
  • Leases for more than nine years, which require a notarial deed (article 618 of the Civil Code)

Contracts that must be “in writing”

Under Law 4727/2020, a qualified electronic signature has the same validity as a handwritten signature, so it meets a written form requirement. Where written form is required, for example to terminate an employment contract, a QES should be used.

E-signatures in Greece: frequently asked questions

Are e-signed employment contracts valid in Greece?

Yes. Employment contracts can be signed electronically. Acts that require written form, such as termination of employment, should be signed with a qualified signature.

Is a simple electronic signature valid in Greece?

Yes for contracts without a form requirement, but it is freely assessed by the court as evidence. A qualified signature has full probative force.

Can a property purchase be e-signed in Greece?

No. Real estate transfers require a notarial deed, so a private electronic signature is not enough.
